WV Governor Taking Legal Action Against NCAA Selection Committee

If nothing else, bringing further political pressure on the NCAA and EXPOSING an injustice that would otherwise remain concealed.

If Beshear was not such a huge UK fan, it is possible the Commonwealth of Kentucky could join the action on behalf of UL .........but that ain't happening.
 
Glad to see this if only to start a conversation that matters. Corruption is corruption and if the NCAA committee is being corrupt, there should be an investigation.

North Carolina has no buisness being picked ahead of West Virginia and since the NCAA committee leader is a UNC alum, there's smoke so the fire department needs to check it out.

Once the process starts, looking into how Clemson got a 5 seed and Louisville a 8 seed, could lead to more evidence of corruption.

We all know sports is a serious buisness with millions of dollars being made, so the notion that this isn't a serious lawsuit because its about a basketball tournament is disingenuous.

It may not go anywhere but the process needs to start. Everyone who pays attention knows how bad the NCAA is in virtually everything it does. Maybe shit like this corrupt bracket will hasten the Universities leaving the NCAA?

Louisville is in a difficult position because the NCAA could easily revoke NCAAT games from the Yum Center in the future. That would of course do real damage to the city as a ton of $ gets poured in for those 4 days.

I believe the agreement we signed on the banner would also impact WBB and volleyball if we tried hanging it. Not 100% on that stuff though.

But it is interesting to see WV looking at this.

I believe any punitive response from the NCAA would be met with much more resistance than what they would be inclined to risk at this time. Not so much with this recent action by the Governor of WV, but more about the current culture for institutions like the NCAA that have become increasingly unpopular with the both the courts and the public.

While I doubt this University is willing to litigate the past NCAA penalties, I believe the combination of the advent of NIL, along with the subsequent facts related to Pitino’s case, would suggest that UL would prevail in its challenge of the NCAA punishment.

In the very unlikely scenario where a lawsuit was initiated by UL, and the Courts decided the trial would be held in Louisville, I believe the NCAA would do everything possible to settle the case on UL terms, knowing its reputation is deeply tarnished universally, and particularly in the 502 area.

I refer to the successful lawsuit that Jerry Tarkanian brought against both the NCAA and UNLV in 1988 as evidence of just how vulnerable the NCAA is when challenged in a lawsuit. That was in 1988, over 35 years ago; at a time when the NCAA reputation was no where close to its tarnished level now.

With all the inconsistencies by the NCAA I can only imagine how ugly it would get in a court room for the NCAA. And then you could bring action for retaliation. I want to see the NCAA go away
 
To achieve what result, exactly?
Maybe to force the selection committee to follow a set rule or format to determine seeding regardless on feel good TV matchups. Throw out the consideration that you don't match up teams from the same conference and let "defined" seedings play out.

Maybe just for a good laugh, write up a computer program using all the analytics that seem to make up a championship caliber team and see what the results are? Then maybe you could fine tweak a few matchups if there is enough reason to. Throw out the human element.

Use either of those two scenarios and I bet U of L doesn't end up with a 8 seed...

pumped up the sec all year. They can’t be made fools of. 🙄

The sec may be “the best”. But 90% of their big OOC wins came early. Some of those teams, like us, have improved dramatically. Maybe the sec has too.

We’ll find out soon.

Its said Auburn is highly upset at the possibility of playing us in the second game.

I just want to get to that game.

Something I've noticed watching SEC basketball: zero defense. All these teams are top scoring. Bama, Florida, UK, Mizzou, Auburn- they are all top 10 in PPG. I've learned two basic things about the NCAAT: it's about PG play and team defense. None of those teams play defense. The only SEC team that plays D is UT.

The so called slights will never end. Expand to 72 teams and the 73rd and 74th teams get ticked off, 84 and the 85th & 86th teams and on and on.
 
I’m okay doing away with the selection committee altogether and giving the at large bids to the teams with the highest regular season winning percentage. If the top conferences don’t like it, then they should stop playing so many conference games and other “made for TV” games.

Just add in the simple requirement that each school must play at least 12 true road games out of their 31 games, and then make that regular season schedule “Cupcake city”!

Nothing, zero, will come of this. WV doesn’t have the jurisdiction to investigate the selection committee, and if a lawsuit is filed, it will go nowhere.
 
UNC is just as worthy to be in as any of "bubble" teams. IU just got rid of a guy for missing the dance in then hire a guy who just missed the dance. SMU and Stanford were good enough to be in. Apparently Louisville was on the bubble before the ACC Tourny. Discounting a league like the ACC to this degree is wild when some of the SEC teams that got in were an absolute joke to be let in. 6-12 in conference doesn't feel worthy to me.

As much as most are pissed at UNC, the best thing for the ACC is for all these "mediocre" ACC teams to go on a run and for the SEC teams like Oklahoma and their shitty record to lose early. Not because I care about the ACC or SEC, but because the ACC's perception really hurt the Cards this year. THe reason Clemson got their #5 is b/c they beat UK and Duke (who even ACC haters agree is amazing).

With all due respect, I sincerely believe that most of the responses on this site to the WVU Governor's lawsuit are missing the intent, and more specifically discounting how this will play out over time.

I urge you to go back and review that chronolgy of events surrounding Jerry Tarkanian's successful lawsuit against the NCAA, and his own University (UNLV). The "member institution logic" is no longer the same obstacle that most have believed it to be for so many years. Luke Hancock's more recent successful legal challenge, of the NCAA while admittedly was not the same as either of the aforementioned events, yet each can be viewed as how an ever-increasing loss of confidence with the NCAA can result in judgements that may not have been even possible in the past.

I am not a lawyer, but one highly respected local Federal Judge, who I grew up with, had told me back at that time, that had UL fans joined Luke's lawsuit to recover the 2013 NC Championship Banner, he was confident that it would have been restored, either by the NCAA, or by the Courts. The anger directed at the NCAA has become universal, and they are weakened by their reputation and the efforts by P5 conference members intent on leaving the Institution if demands are not met.

It may be blowing wind, but I think the crux of the suit is Bubba and his role while he's the AD of UNC. If it can be proved that there was corruption involved in UNC making the tournament over WV because the committee leader is UNC'S AD, there could be some form of retribution.

Of course it doesn't do anything for WV this tournament, but if it forces the NCAA to stop having current AD's on the selection committee, that would be a win. The absurd statement by the committee Bubba wasn't in the room when discussing UNC doesn't stand up to any real scrutiny.

The NCAA has always behaved like they are untouchable because they are mostly never challenged and when they are, nothing really comes from it. There's been a few examples of where they have as mentioned in this thread, but nothing big enough to have a real impact.

I think the WV governor wants the discussion. He wants people to think that the UNC AD used his position to have the Tar Heels picked over more deserving teams. However that transpired is the investigation the governor is seeking.

But on the other hand, courts want to dictate National policies.

Another angle, in these days of NIL why not just blatantly BUY (bribe) your way in?

Courts don't necessarily want to. They are asked to. It's their job to interpret laws.

Not to be contrarian, but virtually all OOC games are played early in the season, so the fact that the big OOC wins came early is not an indication of anything other than that was when the games were played. The SEC collectively won something like 88% of of its OOC games this year, which had literally never been matched. That is why everyone is high on the SEC.

Texas was the 13th best team in the SEC (and the last SEC team in the tournament) and lost to the 4th best team in the Big East. I'm not sure that proves anything other than Texas lost to a better team. It definitely doesn't mean that Texas didn't deserve to be in the tournament or that the SEC is overrated.

If you take the time to examine TX’s 11-2 OOC schedule, you will see the level of competition was unworthy of any serious consideration, particularly that most were on their home floor.

Judging the ACC by two NCAA tournament games is a mistake. In one case, Clemson obviously had a major problem in the first half scoring, in fact, Hunter was scoreless until 10 minutes were left in the 2nd half. I am convinced that UL was physically worn out over the last 7 games. Chucky and Edwards are warriors, but exhausted as they were getting very little support from the rest of the team.

What you imagine other people wearing has nothing to do with me.

You used the fact that the SEC non conference games were early in the season to cast doubt on the SEC as a whole, when all of college basketball plays its non conference games early in the season. Is Duke's record somehow not as good as others because they played non conference games early in the season? No. It was a bad argument to begin with.

To get to your new argument, 75% of the ACC has played and are 1-2. At the time you made that post, just a little over 21% of the SEC has played their first round games and have the same record. Apples and oranges.

The best conference in America won't be known until the tournament is done, but the SEC OOC record this season was statistically the best by any conference in history. The SEC average NET ranking this season was about 31, while the next closest conferences were the Big 10 and Big 12 hovering around 47.

Say what you will about the SEC being overrated, but statistically, there hasn't been a better conference top to bottom so far this season.
