Court ordered mediation failed in players 2013 title lawsiut

Morgan & Morgan get no publicity from a settlement. The stakes need to get higher for the NCAA...
 
They have no real chance in this suit. The players don't have standing, in my opinion and even if Stevens did find in favor of the plaintiffs, it would never stand on appeal. I bet UL and Mack wish this would just stop.

The players have nothing to lose. M&M is providing legal services pro bono, and they want the publicity.

The NCAA is the only entity that stands to lose anything. And the longer this plays out, the higher the stakes get for them. It doesn't require handicapping as far as a winner or loser. It's about what's at risk. I could have predicted that mediation would fail.

Mack doesn't give a flip. The only reason "U of L" would care is the clowns don't wanna see those banners restored...

And, by the way, this does not end “mediation” as the NCAA can come back and make new offers to the 5 players via M&M. In fact, I expect that will happen pretty soon. The NCAA, in view of recent events, has to be very nervous about taking another “legal hit”. It wouldn’t surprise me that this whole thing end up getting our banner back. Just one man’s opinion and I’m entitled.

I'm sure ya'll do hope the banner goes back up, I would if I were in your shoes, but I'm curious what standing any judge would have to do so. I could see him tell the NCAA that they need to announce the the players in the suit were not directly involved in the scandal and that's a stretch. A judge doesn't have a right to dictate to a private membership group just because he wants to. If Stevens tries to do that, it will get reversed on appeal which would actually strengthen the NCAA's position. I don't think the NCAA will make any offer to the plaintiffs at all. They would be foolish to do so as that would weaken them tremendously, opening the door to all sorts of suits and effectively ending their ability to govern their membership as the membership has agreed to be governed.

I’m no internet lawyer. However, the only way the NCAA loses in this case is they negotiate or waffle in any form. Or the court rules the NCAA does not have the right to strip an NCAA championship banner and title from a team which violated NCAA rules.

If there is an amendment to the Constitution granting top college sports recruits unfettered access to scantily clad women I missed it.

I’m a huge fan of the 21st amendment though.
 
I love the "voluntary organization" or "membership" analysis. Evidently, you can murder someone if they're a volunteer. All legal rights go out the window.

The stakes aren't high enough for the NCAA yet. M&M will try to change that...

NCAA thinks it is bulletproof. Won't agree to anything.

Errrrr, have you forgotten about UNC? I sure as hell haven’t as they (the NCAA) totally capitulated to UNC and the threat of their lawyers. Let’s not forget that. That’s the conundrum the NCAA faces now. It appears that those that fight the hardest are those that “win” their cases.

How is this a fail? Is there not big money in ambulance chasing? What part of that statement isn’t true? Are you the most argumentative person on earth or do you know someone worse?

Hmmmmm, apparently you don’t like lawyers or rich people. I truly hope you are never in (or have an) accident where you, or someone you care about, is injured by an act of negativity. Then you’ll want the best (and meanest) trial attorney you can hire. It’s pretty simple. This lawsuit by the five UofL players is about the arrogance of the NCAA and the harshness of their ruling against those players AND the University of Louisville. If I were you I’d be FAR more concerned about the biases and allegiances of the committee members that handed down that unfair and over reaching decision. I know I am.

Taking a step back from this whole thing ... does anybody ever wonder whether or not Pitino purposely dragged the shoe company payments into the open in order to expose how ludicrous it was for the NCAA to take UofL’s 2013 banner for several hundred dollars in extra benefits when players were being paid hundreds of thousands of dollars in extra benefits by the shoe companies to go to Kansas, Kentucky, North Carolina, Duke, etc.?

The dollar value was never the issue. I guess you'd have to tell me what UK recruit was paid at all to go to UK, let alone hundreds of thousands of dollars.

If you're talking about me, I find any attacks against the NCAA interesting. You're also an instate rival and our biggest rival, which makes it more interesting.

As far as Ky goes, I know they beat us this year, but beyond that, I couldn’t even tell you their record. You are just more obsessed than me I guess..

Being able to afford the fight does not equate to being skilled enough to win the fight or being legally correct in the fight.
The issue doesn't necessarily have to be statutory. Could be due process, precedent, or any number of things.

And I'm good with the representation that Luke et al. are getting. Probably at least as good as the clown show would be paying if Gruesome and "Vince" wanted the banners back...

They need high end attorneys experienced in federal court and constitutional matters if they want a chance, not ambulance chasers looking for a marketing angle.

I could be wrong, but my guess is those "ambulance chasers" are more competent than an agenda-driven, slapd!ck, message board interloper...
But less competent than an experienced federal court attorney and even more so, an experienced constitutional law attorney. Go figure.
