Heird On Potentially Getting 2013 Banner Back

I would use the argument how can Kansas keep their banner that was handed to them by the head of the NCAA while they were under a dark cloud.

I am confident that any focused effort by UL to challenge the NCAA over the banner will result in a successful rehanging.

It will have nothing to do with Kansas, UNC or any other school’s experience with the NCAA. UL needs to simply show the differences in the manner the IARP performed it’s due diligence based on facts, versus how the NCAA Committee on Infractions used rumor, innuendo and sensationalism in its conclusions and subsequent penalties.

Luke successfully challenged the NCAA; something the rest of the players should have done as well for defending the banner. The NCAA cannot defend the fact that they punished the innocent (players, fans and even Rick Pitino) without consideration on actual evidence based on direct testimony. Even the notion that Head Coaches must know about everything that is going on year round with their players, assistants ……… is totally unreasonable ……something the IARP made clear in their report.

We will get the banner returned officially by the NCAA once this University presents its challenge.
 
Your post is reasonable and well thought out, 233. It’s also precisely why the NCAA created the IARP to begin with - so that it could handle these FBI-sting cases without setting any precedents that the NCAA would have to follow before or after.

They knew that every top program (and every aspiring program) was cheating in this manner. They created the IARP to be able to wash their hands of this and to be able to say that an independent panel issued whatever punishments that were deemed necessary - not the NCAA.

Its very significant that the IARP panels will be going away once the Arizona and Kansas cases are completed.

Luke was able to successfully fight the NCAA because he wasn't named as a participant in the sordid affair. I recall when that news first broke, Luke took to the air waves and said he never saw anything like what the book described. It's because he wasn't invited to those parties. Also, Luke was named MOP of the 2013 Final Four. He wanted that not to be stricken from the record books like the wins and the banner were, and he won.

Card X ....... you are 100% correct, but that is not why he won his challenge, as there were several other players living in Minardi Hall at that time who were not invited as well. My understanding is the NCAA failed to follow their own interpretation to the rules violation, but allowed the one woman on the Committee to apply her own moral indignation over the recruit reportedly having sex with a prostitute, and essentially demanded the rest of the Committee to "go off script", and apply penalties beyond the NCAA's own guidelines. In fact, there was no direct corroborating testimony to prove that any UL player actually received impermissible benefits, and the young recruit did not sign with UL. As the IARP pointed out, the NCAA allows rumor, innuendo, and 2nd hand testimony as evidence, when the IARP requires direct testimony and facts.

A lot has changed obviously, and the NCAA has become vulnerable to many of their previous decisions being over-turned in civil suits. The addition of the IARP is just one of the first examples of the NCAA recognizing their processes are indeed flawed. If the players and the UL fans step in front of the University and present their challenges to the unprecedented level of penalties as being excessively punitive; I believe we will be successful getting the banner re-hung.

Let’s see how aggressive Heird is to make something good happen for the new regime. I‘ll believe it when I see it…
 
I am beyond being pi$$ed right now. All of this because of lies. A Coach fired a AD resigned.A banner stolen a wasted season for Donovan Mitchell and the Cards that year.All the recruits and winning seasons we have missed out on all because of lies.U of L and Coach Pitino were a soft target for a bunch of rats that once they got caught just started throwing out peoples names trying to reduce their own penalties.I have been a U of L fan ever since we moved to the city in 1978. I wear the Red and Black because it represents the City of Louisville a place that works hard for what it earns. That is why now that I have moved out of state I still wear my Red and Black proudly.We deserve our banner and then 2013 team needs to be honored.Coach Pitino was not perfect but show me a Man walking this Earth that is.I am down with the hanging our heads in shame and looking over our shoulder over everything.It’s time to start holding our heads high again and making teams fear playing the Cardinals.
 
I still find it amazing how the word of a self proclaimed madam who “pimped“ her daughters out was taken as supposed fact. All of the while ruining so many peoples lives off of the word of a criminal who was trying to sell a book on how she supposedly “pimped” her daughters out

Id be all for taking the NCAA out of the banner! ”2013 National Champions” sounds good to me.
Didn't Kansas and unc do something similar ?

Accepting "no" is not acceptable in view of the other crap that's gone down in the NCAA the last 5-10 years. They're using a different set of standards now where punishment is light or nonexistent.

U of L needs to threaten court action if the NCAA does not comply. Of course, we'll probably have to start a GoFundMe page to cover the legal expenses...
 
I believe the civil suit needs to come from the players and the fans; the University need not petition the NCAA. With that said, Heird would do well to avoid dismissing the initiative whenever the topic is raised, and should do everything possible to support the effort.

Really wasn’t any waffling. It really sounded like, “They’ll just say no so we’re not even gonna ask”.

One problem is the 2012 Final Four banner which was also taken down. Pretty sure the NCAA has “Final Four” copyrighted. Don’t think they can copyright “National Champion”.
Then use the term "Semi-finals". It's just semantics. And put up any banners, if applicable, for postseason NIT and NAIB semi-finalist teams.

I have little doubt that the significance of "NCAA" on the banners will wane over time, esp. if the NCAA ceases to exist. U of L regards itself as having won five national championships, only three of which were in the NCAA.

Heird's role in this is simple and easy to pursue... Put up a strong face in opposition. Fans won't blame him if he loses the fight, only if he undertakes it halfheartedly. Saying you'll ask for permission is short of the mark...

This is all you need to know. UCF hung a banner in its football stadium for a Championship they were not invited to but they won out so they crowned themselves Champions.Some of us were their others watched it on Tv. We saw the games played and we saw the confetti fall, we actually were in the game and won the game.Why is it that we don’t have a 2013 Banner hanging?
