CJ Article: group of Louisville fans to sue NCAA over lost championship

I have no idea what's taking place behind the scenes, but I know this- UofL fully cooperated. They self imposed. They politely appealed. They then chose to accept the punishment. It's definitely not a certain, but reinstatement of wins is a possibility. It's happened before. This group doing their own thing, I hope they don't piss off the NCAA. Because if UofL does want reinstatement, which would be a year or two down the road, they need to let everyone know they aren't a part of this.
 
Since bending over and admitting guilt gets you in more trouble than denial and fighting it I wish this group would have stepped up sooner. Maybe they can sue our current administration for doing nothing and get them all fired.
 
Good idea, but honestly this probably wont go anywhere. Is there any history of success?

Not a lawyer, but I think this is the only good legal option. The NCAA will claim our issue is not with them, it's with the clown show...
 
Well guys, to be honest, I think this is a lost cause type battle.
My reasoning is that:
The Tarkanian case pretty much summed up the Supreme Courts opinion that the NCAA is not an agent of the state and that members were voluntary members.

The records are kept by the NCAA, and the title while commonly known is National Champion is actually NCAA Tournament Champion.

The University admitted to repeated rule violation over a four year period (the NCAA stating each instance was violation)

The Penn State atrocity was not involving players or an attempt to influence players, so the NCAA actions were out of their area of authority...as is Baylor and others.

North Carolina....yeah...that was an eff up.
But also a different situation.

I believe this will be an expensive wall you bang your soul against, but then again, it's your team.

The way I look at it is it can't hurt. If a judge decides the case they probably win. So as an attorney you have to figure out how to put the NCAA in a really embarrassing situation so that they settle out of court just to get the thin over with. Maybe that's done through the discovery process who knows. Worth a shot. First thing I would do is extensive research on the people who were on the original committee who decided the case and those on the appeals committee. And if dirt is found start leaking it out.

I don't believe a state court would have jurisdiction and fans have no standing to file suit against the NCAA, in my opinion. In all likelihood the case will be thrown out almost immediately.

Yep lost cause. No legal standing, this issue is between the University and the NCAA. NOT the Fans.
 
Do the UL fans really want to bring subpoena power brought into this situation? McGee might be forced to talk.....

We’ve already been hammered by the NCAA. I would say the only one to have any issues would be Pitino. Then we might get to the bottom of this.

McGee can and should invoke his Fifth Amendment privilege...
That would be smart for him to do, if he were subpoenaed, assuming this all went to trial. Frankly, if I were the plaintiff's attorney, I wouldn't even bring him up, unless I knew that it would help us. I seriously doubt it would do our case any good.
